Terms of Service

Last updated: 8 May 2026

1. The agreement

These terms form a binding agreement between you (the customer) and TenderSearch SA. By creating an account or using the site you accept these terms. If you do not agree, do not use the service.

2. The service

TenderSearch SA aggregates publicly published government tender information from South African government departments, municipalities, State Owned Enterprises and similar sources into a searchable database, with filters, watchlists, alerts and award-history features.

We make a reasonable effort to keep the data accurate and up-to-date, but we cannot guarantee that every tender is captured, that closing dates are correct, or that a source website is reachable at all times. Always verify a tender against the issuing organisation before bidding.

3. Accounts

  • You must give us accurate registration information.
  • You are responsible for keeping your password secret.
  • One account per person. Sharing an account between people is a breach of these terms.
  • Sessions are capped at 4 active devices per account.
  • You must be 18 or older.

4. Subscription and billing

  • Plans start at R149/month. The current price is shown on the pricing page.
  • Subscriptions auto-renew on the same day each month using PayFast. You can cancel at any time from your account page; cancellation takes effect at the end of the current paid month.
  • All prices include VAT where applicable.
  • We do not offer a free tier or free trial. Payment is required for access to gated tender data.
  • If a payment fails we will retry. If it remains unpaid your access is suspended until you update your card.

5. Refunds

Because the service gives you immediate access to a digital data product, monthly subscription fees are not refundable once a billing cycle has started. If you believe you have been charged in error, email info@tendersearch.co.za and we will investigate in good faith.

6. Acceptable use

You agree not to:

  • Scrape, crawl, mirror or bulk-export the site or its data, except via the API key issued for that purpose under a separate agreement.
  • Resell, sublicense or republish the data to third parties.
  • Share your login with anyone else.
  • Use the service to send spam, phishing or unsolicited bulk email.
  • Reverse engineer, probe or attack the service.
  • Use the service to break any South African law.

We may suspend or terminate any account that breaches this section, with or without notice.

7. Intellectual property

The underlying tender notices are publicly issued by government bodies and we do not claim ownership of them. The site, the database structure, the curation, the search interface, the logos and the brand are owned by TenderSearch SA. You may not copy these without our written permission.

8. Disclaimer

The service is provided "as is". We do not warrant that it will be uninterrupted, error-free, or that any specific tender will appear, be accurate, or be awarded. You bid at your own risk.

9. Limitation of liability

To the maximum extent allowed by South African law, TenderSearch SA will not be liable for any indirect, incidental, consequential or special damages, including loss of profits, loss of contracts, loss of business or loss of goodwill, whether or not we were warned of the possibility. Our total liability for any claim relating to the service is capped at the amount you paid us in the 3 months before the claim.

10. Changes

We may update these terms from time to time. If we make a material change we will email account holders. Continued use of the service after the change means you accept the new terms.

11. Governing law

These terms are governed by the law of the Republic of South Africa. Any dispute will be heard in a South African court of competent jurisdiction.
